API Terms of Use – What’s Changed
1. Changes posted July 1, 2026
Summary of updates:
- Clarified that use rights cover Your internal business operations as a PowerPlan customer.
- Prohibited use of false, misleading, or pretext identities, or credentials issued to someone else, to access the APIs.
- Broadened the anti-circumvention language to cover bypassing, evading, or circumventing PowerPlan’s network and application security measures.
- Prohibited use of bots, scrapers, AI agents, headless browsers, and other automated tools to access the APIs outside of authorized API calls.
- Expanded the reverse engineering prohibition to cover AI-assisted observation, testing, or mirroring of the APIs and PowerPlan Offerings.
- Prohibited use of the APIs, or any data derived from them, to train AI models or build competing products.
- Added an audit right allowing PowerPlan to verify compliance, including on suspicion of unauthorized use or security incidents.
2. Changes posted April 1, 2025
Summary of updates:
- Removed fees, warranty disclaimer, liability limitation, indemnity, term and termination, export controls, and miscellaneous provisions so as not to conflict with the corresponding provisions of the Contract.
3. Changes posted July 1, 2024
Summary of updates:
- Changed ‘Modifications to the TOU’ provision to the ‘Version Updates’ provision to make clear that new versions of the TOU will become effective upon a customer’s next renewal of its Contract.
